Chinese blogger fined for leaking Xiaomi cellphone video

Chinese manufacturer Xiaomi sued a Chinese blogger who posted a video regarding the Xiaomi Mi 10 Ultra smartphone before the device’s official announcement.

Known as Beautiful Technology, the digital influencer is called Gu Xuyang and published in August 2020 a complete smartphone unboxing in advance. Detail: the content creator signed a confidentiality agreement to respect an embargo and not post anything about the model until a certain date.

As a result, he was sentenced to pay a fine of 1 million yuan, approximately R$760.5 thousand in direct currency conversion. In addition, the blog posted an apology on the Chinese social network Weibo explaining the situation.

The case was taken to the country’s regulatory bodies, such as the China International Economic and Trade Arbitration Commission. The institution determined that the video “caused serious consequences” for the manufacturer.

The case was considered more serious because it did not only involve leaked material, but professional content that violated a contract previously established between the parties.

Whose fault is it?

However, the story gets even more unusual. Apparently, Xuyang claimed that it was his mother who accidentally posted the video. According to the story told by the blogger, both share the same device and she “accidentally” posted the video on a social network, because she thought it was content that was ready to be played on social networks.

The clip was even later deleted, but not before copies and screenshots were made and spread across the internet.
